1. General Provisions
These Terms and Conditions (hereinafter "Terms") govern the access to and use of the Cardixx platform, including the Cardixx mobile application, the Cardixx website (www.cardixx.com), and all related services (collectively, the "Platform") provided by Cardixx e.U. (hereinafter "Cardixx", "we", "us", or "our"), a sole proprietorship registered in Austria under company register number FN 676853 y, with its registered address at Cumberlandstrasse 43, 1140 Wien, Austria.
By creating an account, accessing, or using the Platform in any way, you (hereinafter "User", "you", or "your") agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Platform.
These Terms apply to all categories of users, including:
- Individual users (professionals, freelancers, founders, jobseekers) — B2C
- Business and team users (companies and organisations) — B2B
- Networking Hub operators (coworking spaces, business cafes, event organisers, and other venue operators) — B2B
For Networking Hub operators, these Terms apply alongside and are supplemented by the individual written contract agreed between the hub operator and Cardixx. In the event of any conflict between these Terms and the individual hub contract, the individual contract shall prevail.
2. Definitions
- Platform: The Cardixx mobile application, website (www.cardixx.com), and all related features and services.
- User: Any individual or organisation that registers for or uses the Platform.
- Individual User: A natural person who registers for the Platform for personal professional networking purposes.
- Business User / Team: A company or organisation that registers for a Teams or Teams Pro plan for use by its employees or members.
- Networking Hub: A venue (coworking space, business cafe, restaurant, hotel lounge, event space, or similar) that has applied, been approved, and signed an individual contract with Cardixx to be listed as a Networking Hub on the Platform.
- Digital Business Card: A digital profile created by a User containing professional and contact information, shareable via QR code, NFC, or link.
- Wallet: The in-app feature allowing Users to store and manage Digital Business Cards received from other Users.
- Networking Hub Profile: The public profile of a Networking Hub displayed in the Cardixx app and on the Cardixx website.
- Check-in: The act of a User registering their presence at a Networking Hub location using the Platform.
- Content: Any data, text, images, files, or other material submitted to or generated on the Platform by a User.
- Personal Website: A public webpage hosted by Cardixx under a unique URL (cardixx.com/mycards/[username]) that displays a User's Digital Business Card information.
3. Account Registration and Eligibility
3.1 Eligibility
To register for and use the Platform, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract under the laws of your country of residence
- Not be prohibited from using the Platform under applicable law
- Provide accurate, current, and complete information during registration
3.2 Registration Methods
Users may register using their email address (with OTP verification), their Apple account (via Sign in with Apple), or their Google account (via Google OAuth). By registering via a third-party provider, you authorise Cardixx to receive certain information from that provider as described in our Data Information Document.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Cardixx immediately at info@cardixx.com if you become aware of any unauthorized use of your account. Cardixx shall not be liable for any loss or damage arising from your failure to secure your account.
3.4 One Account Per Person
Each individual may only hold one active personal account on the Platform. Creating multiple accounts for the same individual is prohibited. Business Users may register a single account for their organisation and create sub-accounts for team members in accordance with their subscription plan.
4. Subscription Plans and Pricing — Individual Users (B2C)
Cardixx offers the following plans for individual users:
4.1 Free Plan
The Free Plan is available to all registered individual users at no charge. It includes:
- Up to 2 Digital Business Cards
- Basic card sharing (QR code, NFC, link)
- Save contacts to Wallet
- Limited check-in visibility and limited event access
- Limited card template selection
- Limited networking distance radius
- Basic analytics (total views overview)
- App available in 7 languages (EN, DE, TR, FR, IT, ES, PL)
The Free Plan is subject to feature limitations as determined by Cardixx from time to time. Cardixx reserves the right to modify the features included in the Free Plan with reasonable notice.
4.2 Plus Plan — One-Time Payment
The Plus Plan unlocks all individual user features on the Platform for a one-time payment of EUR 19.90 (nineteen euros and ninety cents). The Plus Plan includes all Free Plan features plus:
- Unlimited Digital Business Cards
- Advanced card template editing and exclusive card designs
- Full check-in access for networking (no distance restriction)
- Full analytics dashboard (Unique Viewers, Share Views, Link Clicks, Exchanges, New Connections, Location Map, Link Breakdown, Industry Distribution, Viewer Insights)
- Print-ready business cards
- Personal Website (public profile at cardixx.com/mycards/[username])
The Plus Plan is a one-time, lifetime purchase. There are no recurring fees or renewals. Payment is processed at the time of purchase. The Plus Plan is non-refundable once activated, except as required by applicable consumer protection law.
Prices include applicable taxes where required by law. Cardixx reserves the right to change the price of the Plus Plan for new purchases; existing Plus Plan holders are not affected by price changes.
5. Networking Hub Plans and Contracts
Networking Hub operators (coworking spaces, business cafes, restaurants, hotel lounges, event organizers, and similar venues) may apply to join the Cardixx Networking Hub Network through the Platform.
5.1 Application Process
To become a Networking Hub, venue operators must submit an application through the Cardixx app or website providing venue details, address, contact person information, and a venue signage photo. Cardixx will review the application, conduct an online meeting with the applicant, and issue a decision. Acceptance is at the sole discretion of Cardixx.
5.2 Individual Hub Contract
Each approved Networking Hub operates under an individual written contract agreed between Cardixx and the hub operator. The individual contract governs:
- Contract duration and renewal terms
- Subscription pricing (which varies based on hub size, location, and other factors agreed between the parties)
- Data categories collected and processed
- Services provided by Cardixx to the hub
- Termination conditions and notice periods
- Any additional hub-specific terms
In the event of any conflict between these general Terms and the individual hub contract, the individual hub contract shall prevail.
5.3 Hub Features
Approved Networking Hubs receive:
- A public Networking Hub profile in the Cardixx app and on the Cardixx website
- A Verified Networking Hub badge
- The ability to be discovered by Cardixx users and receive check-ins
- Access to in-app Hub Analytics (check-in data, engagement metrics, audience demographics)
- Access to Web Analytics for the hub's dedicated Cardixx webpage
- The ability to create and host networking events on the Platform
- Exclusive event analytics and dashboard
5.4 Hub Pricing
Networking Hub pricing is not fixed and is determined individually for each hub based on factors including but not limited to: hub size, location, type of venue, and the scope of services agreed. All pricing is set out in the individual hub contract. Cardixx does not publicly disclose standard hub pricing.
6. Payment Terms
6.1 Accepted Payment Methods
Cardixx accepts the following payment methods: credit card (Visa, Mastercard, American Express), debit card, Apple Pay, and Google Pay. All payments are processed through a certified third-party payment service provider.
6.2 Currency and Taxes
All prices are displayed in Euros (EUR) and include applicable taxes where required by law. Users outside the European Union may be subject to additional local taxes or duties, for which they are solely responsible.
6.3 Failed Payments
If a payment fails for a recurring subscription (Teams or Teams Pro), Cardixx will notify the account administrator. If payment is not resolved within 7 days, Cardixx reserves the right to suspend or downgrade the account to the Free Plan until payment is resolved.
6.4 Refunds
The Plus Plan one-time payment is non-refundable once the features have been activated, except as required by applicable Austrian or EU consumer protection law (including the right of withdrawal under the Austrian Fernabsatzgesetz / EU Consumer Rights Directive within 14 days of purchase, where applicable). Monthly subscription fees for Teams and Teams Pro plans are non-refundable for the current billing period upon cancellation. Refund requests should be submitted to info@cardixx.com.
7. User Obligations and Prohibited Conduct
7.1 Accurate Information
Users must provide accurate, truthful, and up-to-date information in their Digital Business Cards, profiles, and any other content submitted to the Platform. Cardixx does not verify the accuracy of user-submitted information and is not responsible for any reliance placed on such information by other users.
7.2 Professional Use
The Platform is designed for professional networking purposes. Users agree to use the Platform in a professional and respectful manner. The Platform may not be used for personal dating, solicitation, spam, or any non-professional purpose.
7.3 Prohibited Conduct
Users must not:
- Submit false, misleading, or fraudulent information
- Impersonate any person, company, or organisation
- Use the Platform to send unsolicited commercial messages (spam)
- Harass, threaten, intimidate, or abuse other users
- Upload, share, or transmit any content that is unlawful, defamatory, obscene, discriminatory, or violates the rights of any third party
- Attempt to gain unauthorised access to the Platform, other user accounts, or Cardixx systems
- Use automated tools, bots, scrapers, or similar technologies to access or extract data from the Platform without prior written consent from Cardixx
- Reverse engineer, decompile, or disassemble any part of the Platform
- Use the Platform in any way that could damage, disable, or impair the Platform or its servers
- Violate any applicable local, national, or international law or regulation
7.4 Reporting Violations
Users may report inappropriate behaviour, abusive content, or suspected violations through the in-app Report and Block function. Cardixx will review reports and take appropriate action, which may include warning, suspending, or permanently banning the offending user.
8. User Content
8.1 Ownership
Users retain ownership of all content they submit to the Platform, including Digital Business Card information, profile data, uploaded photos, files, and other materials (collectively "User Content").
8.2 Licence to Cardixx
By submitting User Content to the Platform, you grant Cardixx a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Platform and its features. This licence does not grant Cardixx the right to sell your User Content to third parties or use it for advertising purposes.
8.3 Public Content
If you choose to publish a Personal Website (public profile) or if your hub profile is publicly listed, you acknowledge that the information you have chosen to make public will be accessible to anyone on the internet, including search engines. You are solely responsible for the content you choose to make public. You may take your Personal Website offline at any time by toggling the Public Website setting to off.
8.4 Content Standards
All User Content must comply with applicable law and must not infringe the intellectual property rights, privacy rights, or other rights of any third party. Cardixx reserves the right to remove any User Content that violates these Terms or applicable law, without prior notice.
9. Intellectual Property
All intellectual property rights in the Platform, including but not limited to the Cardixx name, logo, software, design, features, and documentation, are owned by or licensed to Cardixx e.U. Nothing in these Terms grants you any right, title, or interest in or to the Platform's intellectual property beyond the limited right to use the Platform in accordance with these Terms.
The Cardixx name, logo, and brand are trademarks of Cardixx e.U. You may not use these trademarks without the prior written consent of Cardixx.
10. Privacy and Data Protection
Cardixx processes personal data in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (Datenschutzgesetz — DSG). Full details of how we collect, use, store, and protect your personal data are set out in our Data Information Document (Datenschutzhinweis), available at www.cardixx.com.
By using the Platform, you acknowledge that you have read and understood our Data Information Document. The Data Information Document forms an integral part of these Terms.
11. Platform Availability and Changes
11.1 Availability
Cardixx aims to provide continuous access to the Platform but does not guarantee uninterrupted availability. The Platform may be temporarily unavailable due to scheduled maintenance, technical issues, or circumstances beyond Cardixx's control. Cardixx shall not be liable for any loss or inconvenience caused by temporary unavailability.
11.2 Changes to the Platform
Cardixx reserves the right to modify, update, add, or remove features of the Platform at any time. Where changes materially affect paid subscribers, Cardixx will provide reasonable advance notice. Continued use of the Platform after changes take effect constitutes acceptance of the modified Platform.
11.3 Changes to These Terms
Cardixx reserves the right to update these Terms at any time. Users will be notified of material changes via email or in-app notification at least 14 days before the changes take effect. If you do not agree with the updated Terms, you must stop using the Platform and may delete your account. Continued use after the effective date constitutes acceptance of the updated Terms.
12. Account Termination and Suspension
12.1 Termination by the User
Individual users may delete their account at any time through the app settings or by contacting info@cardixx.com. Upon account deletion, all personal data is retained for 1 year and then permanently deleted, except for data subject to statutory retention obligations (e.g. payment records retained for 7 years under Austrian tax law).
12.2 Termination by Cardixx
Cardixx reserves the right to suspend or permanently terminate any user account, with or without prior notice, where:
- The user has materially breached these Terms
- The user has engaged in fraudulent, abusive, or unlawful conduct
- Cardixx is required to do so by law or court order
- Continued access poses a risk to the Platform, other users, or third parties
Where termination is due to a breach of these Terms, no refund will be issued for any remaining subscription period.
12.3 Termination of Networking Hub Contracts
Termination of a Networking Hub's participation on the Platform is governed by the individual hub contract. Upon contract termination, the hub profile will be unpublished immediately and all hub data will be permanently deleted within a maximum of 1 month from the termination date. Financial records are retained for 7 years in accordance with Austrian tax law.
12.4 Effect of Termination
Upon account or contract termination, your right to access and use the Platform ceases immediately. Any content you have submitted to the Platform will be handled in accordance with the retention periods set out in our Data Information Document.
13. Limitation of Liability and Disclaimer
13.1 No Warranty
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Cardixx does not warrant that the Platform will be error-free, uninterrupted, or free of viruses or other harmful components.
13.2 Limitation of Liability
To the fullest extent permitted by applicable law, Cardixx shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Platform, including but not limited to loss of profits, loss of data, loss of business opportunities, or reputational damage, even if Cardixx has been advised of the possibility of such damages.
Cardixx's total liability to you for any claim arising from or related to these Terms or the Platform shall not exceed the amount you have paid to Cardixx in the 12 months preceding the event giving rise to the claim. For Free Plan users, Cardixx's liability is limited to EUR 100.
13.3 Third-Party Content and Services
The Platform may contain links to third-party websites or integrate with third-party services (e.g. Google Maps, Apple Maps, payment processors). Cardixx is not responsible for the content, availability, or practices of any third-party service. Your use of third-party services is subject to their own terms and privacy policies.
13.4 User Interactions
Cardixx is not responsible for the conduct, content, or actions of any user of the Platform. Any disputes between users must be resolved directly between the parties involved. Cardixx may, at its discretion, assist in dispute resolution but is under no obligation to do so.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts of Vienna, Austria, unless mandatory consumer protection law in your country of residence provides otherwise.
For consumers within the European Union, the European Commission's Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr/. Cardixx is not obligated to participate in alternative dispute resolution proceedings but may do so at its discretion.
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with our Data Information Document (Datenschutzhinweis) and, for Networking Hub operators, the individual hub contract, constitute the entire agreement between you and Cardixx with respect to the Platform and supersede all prior agreements, representations, and understandings.
15.2 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
15.3 No Waiver
Cardixx's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Cardixx.
15.4 Assignment
You may not assign or transfer your rights or obligations under these Terms to any third party without the prior written consent of Cardixx. Cardixx may assign these Terms or any of its rights and obligations hereunder to a successor or affiliate without your consent, provided that such assignment does not materially diminish your rights under these Terms.
15.5 Language
These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
